Everton have secured the services of Mark Howard KC to spearhead their defence in a compensation dispute with Burnley, stemming from the latter's relegation crisis during the 2021/22 season. Howard, an esteemed barrister, previously represented the Toffees during their Profit and Sustainability Review hearing last year. The Clarets allege that their financial losses due to relegation are linked to Everton's violation of the Premier League's profit and sustainability regulations. The fallout for Everton followed a breach in both the 2021/22 and 2022/23 financial years, with the repercussions manifesting in the form of a hefty 10-point deduction, later reduced to six. Notably, the additional penalty of two points for 2022/23, despite being concurrent, plays a pivotal role as clubs eye compensation. Burnley, along with Leeds United, Leicester City, Nottingham Forest, and Southampton, are pursuing claims, motivated by the severe revenue drop that accompanies relegation. Should the six-point penalty for 2021/22 stand, it would have left Everton languishing in the bottom three with just 33 points, sending them down to the Championship, while Burnley finished that season just above with 35 points. The hearing is scheduled for this summer at the International Dispute Resolution Centre for Arbitration and Mediation in London. The same body that ruled on Everton's initial deductions will also assess Burnley's claims for financial redress.
